Terms of Service

1. Acceptance of Terms

Cutaroo (the "App") is operated by Cutaroo LLC, a California limited liability company ("Cutaroo," "we," "us," or "our"). By downloading, accessing, or using the App, you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the App.

If you are under 18, you may use the App only with the involvement and consent of a parent or legal guardian. If you are a parent or guardian permitting a child to use the App, you agree to these Terms on their behalf and are responsible for their use of the App.

2. The Service

Cutaroo is a daily precision-cutting puzzle game. We provide the App and its features — including daily and bonus shapes, Cut Quest, leaderboards, in-game coins, avatars, and cosmetic items — for your personal, non-commercial entertainment.

The App may display advertising (see Section 8) and may offer optional in-app purchases (see Section 6). Neither is required to play.

We may add, change, suspend, or remove features at any time.

3. Anonymous Play and Optional Accounts

Cutaroo does not require you to create an account. On first use, the App generates an anonymous identifier and assigns you a randomly generated display name so your progress can be saved and shown on leaderboards. When you play anonymously:

• Your progress is associated with your device, not with a personal account.
• Uninstalling the App, clearing your device data, or switching devices may permanently delete your progress, coins, and items.
• We cannot recover progress for an anonymous session that has been lost.

Optional accounts. To save your progress and sign in on another device, you may optionally create an account using a username and a password (and, if you are 13 or older, an optional email address). If you create an account, you are responsible for keeping your credentials confidential and for all activity that occurs under your account. Do not share your password. You may sign in on a new device by entering your username (or email, if you added one) and password, and you may permanently delete your account at any time from Settings → account → Delete account (see Section 13). We are not liable for lost progress, coins, or Virtual Items, including any loss resulting from a lost anonymous session or lost account credentials.

4. Age Information

When you first open the App, we ask you to indicate your age. We use this information to configure your experience and to comply with applicable laws protecting children's privacy. You agree to provide accurate age information.

Users who indicate they are under 13 receive additional protections, described in our Privacy Policy, including a randomly generated display name and no ability to enter free-form text as a username.

5. Display Names and Conduct

Your display name appears publicly on leaderboards. You agree that any display name you select or enter will not be offensive, harassing, hateful, sexually explicit, deceptive, impersonating, or infringing on any third party's rights.

We may change, reset, or remove any display name at our discretion.

You further agree not to:

(a) cheat, use bots, scripts, emulators, or automation to affect gameplay or scores; (b) exploit bugs, glitches, or unintended mechanics for advantage; (c) manipulate leaderboards or create multiple identities to gain advantage; (d) reverse engineer, decompile, or disassemble the App, except where such restriction is prohibited by law; (e) interfere with, disrupt, or attempt to gain unauthorized access to our systems, servers, or other users' data; (f) upload or transmit viruses or malicious code; or (g) use the App for any unlawful purpose.

We may remove scores, reset progress, or restrict or terminate access for conduct that violates these Terms.

6. Virtual Items, In-Game Currency, and Purchases

The App includes virtual coins, avatars, skins, and other cosmetic items ("Virtual Items"). You acknowledge and agree that:

• Virtual Items have no monetary value and are not real currency.
• Virtual Items cannot be redeemed, exchanged, or cashed out for money, goods, or anything of value outside the App.
• You do not own Virtual Items. We grant you a limited, revocable, personal, non-transferable license to use them within the App.
• Leaderboard coin awards are in-game rewards only and carry no cash value.
• We may modify, manage, devalue, or eliminate Virtual Items at any time.
• Virtual Items may be lost if your anonymous progress is lost (see Section 3) or if your access is terminated.

In-app purchases. The App may offer optional in-app purchases — for example, in-game coins or cosmetic items. Purchases are never required to play, and every gameplay feature remains reachable without spending money. If you make a purchase, the following apply:

• Processed by the app store. All purchases are processed by the Apple App Store or Google Play under their terms. We never receive or store your payment card, bank, or billing details.
• What you are buying. A purchase grants the limited, revocable licence to use Virtual Items described above. It does not transfer ownership, and Virtual Items still have no monetary value and cannot be cashed out.
• Refunds. All sales are final except where a refund is required by applicable law or granted under the app store's own refund policy. Refund requests must go to Apple or Google, not to us — we cannot issue refunds for store-processed transactions.
• Pricing. We may add, change, or discontinue purchasable items and change their prices at any time. Price changes do not apply retroactively to purchases already made.
• Loss of purchased items. Virtual Items obtained by purchase are subject to the same risks as any other Virtual Item, including loss if your anonymous progress is lost (see Section 3). We strongly recommend creating an account before making any purchase so your items are tied to credentials you can sign back in with.
• Under 13. Users who indicate they are under 13 cannot make in-app purchases.
• Parents and guardians. If you permit a minor to use your device or app store account, you are responsible for purchases made through it. We recommend enabling your platform's purchase controls (Apple Screen Time / Ask to Buy, or Google Play parental controls and purchase authentication).

Membership plans. The App offers two optional auto-renewing monthly subscriptions: Cutaroo Crew, which unlocks one scissor group of your choosing and grants a daily bonus of in-game coins; and Club Cutaroo, which unlocks two scissor groups of your choosing, the Club-exclusive scissors and necklace, the Bonus Shape, and a larger daily coin bonus. You choose which, if either, to buy. The current plans, their prices, and their billing periods are always shown in the App before you confirm a purchase, and prices are displayed in your local currency by the app store. Both are entirely optional: the App remains fully playable, with every gameplay feature reachable, without either.

• What each plan gives you. Cutaroo Crew unlocks one scissor group you select and grants 100 in-game coins each day. Club Cutaroo unlocks two scissor groups you select, the Club-exclusive scissors and necklace, the Bonus Shape, and grants 500 in-game coins each day. You choose your scissor group or groups once per billing period. The choice is final once you confirm it, and you can choose again when your subscription renews. Both plans grant in-game coins and Virtual Items as described. Neither changes how scoring works and neither confers any advantage on the leaderboards — placement depends only on the scores you cut. Neither plan currently affects advertising, because the App does not presently show any; if advertising is introduced, active subscribers will not be shown it.
• Auto-renewing subscriptions. If you buy a subscription, it renews automatically at the price and interval shown at purchase unless you cancel at least 24 hours before the end of the current period. Your app store account is charged for renewal within the 24 hours before the current period ends. Payment is charged to your Apple App Store or Google Play account on confirmation of purchase.
• Managing and cancelling. You can manage a subscription and turn off auto-renewal at any time in your app store account settings (iOS: Settings → your name → Subscriptions; Android: Play Store → Payments and subscriptions → Subscriptions). Deleting the App does not cancel a subscription — you must cancel it through the app store. Cancelling stops future renewals; it does not retroactively refund the current period, and your plan's benefits continue until the end of the period you have already paid for. When the plan ends, anything it unlocked relocks, including any scissors it granted; anything you bought with in-game coins stays yours.
• Free trials or introductory offers. If we ever offer one, any unused portion of a free period is forfeited when you buy a subscription, and the subscription converts to the standard price at the end of the offer unless cancelled beforehand.
• Price changes. We may change the price of a subscription or of the one-time option. For an existing subscription, a price increase takes effect only after the app store has given you the notice and consent options it requires, and you may cancel instead.
• Restoring your purchase. A membership plan is tied to the app store account you bought it with, not to your Cutaroo progress. If you reinstall the App, change device, or lose anonymous game progress, use Restore Purchases in the App to recover it, signed in to the same Apple or Google account. This is different from Virtual Items, which are tied to your Cutaroo account and can be lost with it.
• Advertising. The App does not currently display advertising. If it is introduced, this section and our Privacy Policy will be updated before it appears, and anyone holding an active membership plan at that time will not be shown it.
• Under 13. Users who indicate they are under 13 cannot buy either membership plan, or make any other in-app purchase. If advertising is introduced, users under 13 would see only non-personalized advertising.
• Refunds. As with all in-app purchases, refunds are handled by Apple or Google under their policies, not by us.

How the App is funded. Cutaroo is free to play. We currently earn revenue only from optional in-app purchases and memberships. The App does not display advertising today; if that changes, this section and our Privacy Policy will be updated before any advertising appears.

7. Intellectual Property

The App and all of its contents — including its source code, artwork, shape designs, silhouettes, characters, audiovisual elements, the Cutaroo name and logo, and all related branding — are owned by Cutaroo LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. CUTAROO is a trademark of Cutaroo LLC.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App for personal, non-commercial entertainment. You may not copy, reproduce, distribute, publicly display, modify, translate, create derivative works from, sell, or commercially exploit the App or any part of it without our prior written permission.

Nothing in these Terms transfers any ownership interest to you.

8. Third-Party Services

The App relies on third-party services, including our cloud backend and hosting providers, to operate and store game data. Your use of the App may be subject to those providers' own terms and privacy practices. We are not responsible for the acts, omissions, content, or practices of third-party services.

Advertising. The App may display advertising, including advertising served by third-party ad networks. Users who indicate they are under 13 are shown only non-personalized (contextual) advertising. Ads are supplied by the ad network, not by us: we do not control and are not responsible for the content of any advertisement, for any website or app an advertisement links to, or for any product, service, or offer advertised. Any dealings you have with an advertiser are solely between you and that advertiser. Do not tap an advertisement if you do not wish to leave the App. What data advertising involves, and your choices about it, are described in Section 4 of our Privacy Policy.

The App is distributed through the Apple App Store and Google Play. Your use is also subject to those platforms' terms. Apple and Google are not parties to these Terms and have no responsibility for the App.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT PROGRESS, SCORES, OR VIRTUAL ITEMS WILL BE PRESERVED.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CUTAROO LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROGRESS, COINS, VIRTUAL ITEMS, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) TWENTY-FIVE U.S. DOLLARS ($25.00).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Cutaroo LLC and its members, managers, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

12. Changes to the Terms

We may modify these Terms at any time. When we do, we will update the "Last updated" date above and, where the changes are material, provide notice in the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree, stop using the App.

The advertising described in Section 8 and the in-app purchases described in Section 6 are already permitted by these Terms. Beginning to show ads or offer purchases is therefore not a modification of these Terms and does not require separate notice.

13. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the App at any time, and if you created an account you may permanently delete it and its associated data from within the App (Settings → account → Delete account). Deleting your account is irreversible and removes your profile, credentials, saved progress, coins, streak, and leaderboard history. Sections 6, 7, 9, 10, 11, 14, and 15 survive termination.

14. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

15. Miscellaneous

Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cutaroo LLC regarding the App.

Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
